Position Title: Senior Manager (Investigations and Enforcement)

The Capital Markets Authority is a statutory agency charged with the responsibility of regulating and developing an efficient capital market in Kenya.

The Authority invites applications from qualified candidates for the following positions:

Job Purpose: Reporting to the Director, Market Operations, the Senior Manager Investigations and Enforcement will be responsible for providing technical leadership and strategic direction in the design, implementation and evaluation of the Authority’s Investigation and Enforcement functions for purposes of meeting the Authority’s supervisory and regulatory statutory mandate.

The successful candidate will serve on a five (5) year contract renewable based on performance.

The Authority will offer a competitive remuneration package to the successful candidate.

Job Responsibilities

1) Develop investigation and enforcement strategy, systems, procedures and programs to achieve protection of investors’ interest, enhance market integrity and increase
deterrence;

2) Develop capital market intelligence gathering frameworks for the Investigation and Enforcement Department;

3) Spearhead the process leading to prosecution, defence and administrative actions against regulated persons in cases where the capital markets legal and regulatory
framework has been contravened;

4) Lead and manage representation of the Authority in hearings in courts, tribunals and other fora;

5) Facilitate relationships with domestic and international strategic partners to promote successful prosecutions;

6) Advise on the legal and regulatory gaps, trends in violations, to inform policy and regulatory reforms to ensure efficient and effective investor protection; and

Minimum Requirements

a) Bachelors Degree in Law, Finance or a relevant field;

b) Relevant Masters Degree;

c) Member of professional body in good standing such as CS(K), CPA (K), ACCA, CFA, CFE, CISA, LSK where applicable;

d) At least eight (8) years of work experience in a managerial role and

e) Management course lasting not less than four (4) weeks is an added advantage.

Key skills, Knowledge & Competencies

a) Understanding of investigations and enforcement of capital markets operations as well as financial sector operations;

b) Understanding of the Kenyan legislative and judicial systems;

c) Professional skepticism;

d) Legal analysis;

e) Knowledge of strategic management, project planning and budgeting, resource management, implementation as well as monitoring and evaluation;

f) Efficiency and objectivity in reviewing investigations and enforcement reports;

g) Ability to maintain high standards of personal and professional integrity; and

h) Good judgement.
